Apostille Procedure 

An Apostille is a special stamp providing a document legal status in the countries - participants of the Hague Convention. If the country has not signed the Hague Convention, it is necessary to go through the full consular legalization of documents. 

An Apostille can be affixed only to an official document, which was issued in a country; it means that the authorized authorities in Ukraine may affix Apostille on Ukrainian documents only. 

According to the Resolution of the Cabinet of Ministers of Ukraine dd. January 18, 2003 No.61, Apostilles are affixed by the following Competent Authorities designated by the government: 

 - Ministry of Justice of Ukraine, http://www.minjust.gov.ua

 - Ministry of Foreign Affairs of Ukraine, http://www.mfa.gov.ua

 - Ministry of Education and Science of Ukraine, http://www.mon.gov.ua 

What Types of Documents Are Eligible?

• Documents related to education (diplomas, certificates, archival references, curricula).

• Documents issued by departments of the Bureau of Acts of Civil Status (certificates, references).

• Notarial documents (declarations, letters of attorney, affidavits, etc.).

• Certificates (police clearance, residence certificates, medical examination forms).

• Legal documents (certificates of registration, letters of attorney, statutes, etc.)..

What Types of Documents Apostille is not affixed to?

• Originals, copies and photocopies of passport documents, military registration cards, employment history booklet, authorizations to possess weapons, vehicle registration certificates, identity cards, statutory instruments and their interpretations and legal basis for their use, documents with the nature of the correspondence.

• Documents issued by foreign diplomatic institutions.

• Administrative documents directly related to commercial or customs operations.

• Original official documents issued by authorities of the former republics of the USSR..

Double Apostille:

In certain cases some countries require that double Apostille is affixed to documents. This means that the first Apostille is placed on the original or notarized copy of the document which then undergoes the notarized translation procedure followed by affixing the second Apostille to the translation certified by a notary.

Countries that require double Apostilles: Belgium, Britain, Denmark, India, Italy, Netherlands, Norway, Portugal, USA, France, Switzerland, and Sweden.

Apostille Followed by Further Consular Legalization of the Translation

There is a number of states with two possible ways of legalization:

  • apostille on document + notarized translation + the second Apostille;

  • apostille on document + accredited translation with the consular seal.

Those countries are: Italy, Spain and France
