Citizenship of Ukraine

Citizenship of Ukraine 

Matters of citizenship of Ukraine are regulated by the Constitution of Ukraine, the Law of Ukraine "On Citizenship of Ukraine", Decree of the President of Ukraine № 215 dd. 27.03.2001 "On Compliance of the Law of Ukraine "On Citizenship of Ukraine", as amended by the Decree of the President of Ukraine № 588 dd. 27.06.2006, according to which the order of submission of documents and execution of the previously approved decisions is approved. 

According to art. 6 of the Law of Ukraine "On Citizenship of Ukraine", the following grounds for the citizenship of Ukraine are listed: 

• - By birth.

• - By territorial origin.

• - Due to the naturalization.

•  - Due to the restoration of citizenship.

• - Due to the adoption.

• - Due to the establishment of custody or guardianship, the transfer of child to a family-type orphanage or to a receiving family, and the transfer of child for education to a family of foster parent.

• - Due to the establishment of custody of the person recognized by the court as incapable.

• - Due to the citizenship of Ukraine of one or both parents.

• - Due to recognition of paternity or maternity or establishment of paternity or maternity. 

To access the citizenship of Ukraine, except the grounds listed in Art. 6 of the Law of Ukraine "On Citizenship of Ukraine", a foreign citizen shall meet the following conditions: 

• - Recognize and uphold the Constitution and laws of Ukraine.

• - To be admitted the citizenship of Ukraine it is necessary first to get a permission to immigrate to Ukraine.

• - The foreign national shall renounce their citizenship by filing a declaration of absence of the foreign citizenship.

• - Accommodation in Ukraine should be at least 5 years (in this case there is an exception if the foreign national is married to a citizen of Ukraine for at least 2 years).

• - Knowledge of the state language.

• - A very important condition is the existence of direct income/earnings, which do not contradict the legislation of Ukraine. 

It should also be remembered that the citizenship of Ukraine for foreign persons is not possible in the following cases: 

• - Commission of a crime against humanity or genocide.

• - A person is convicted of the offence or is imprisoned.

• - A person has committed a grave or especially grave crime in other countries. 

Today in Ukraine there are two options for accessing the citizenship of Ukraine: by the general procedure or by advanced procedure. 

General Procedure of Accessing the Citizenship of Ukraine

According to the general procedure, accessing the citizenship of Ukraine shall be performed within a period of 1 year. Acceleration is possible, but only in certain situations. For example, the basis for the advanced citizenship of Ukraine is the presence of Ukrainian residence permit.

Advanced Procedure of Accessing the Citizenship of Ukraine

The advanced procedure of accessing the citizenship of Ukraine shall take a period of 1 month. The reason for this procedure is the presence of direct relatives (brothers, sisters, grandparents, grandchildren, etc.) being the citizens of Ukraine or if the applicant previously was a citizen of Ukraine.
